In addition, we collect any information from others that is necessary for us to properly process a claim, administer benefits, or to otherwise complete a transaction requested by our customer or policyholder.

Information We Disclose

We do not disclose any nonpublic personal information about our customers or former customers to any third party, except as permitted by law, such as for completing a requested transaction, and/or if authorized by our customer. For various business reasons, we may need to provide our customer's personal information to our affiliates or others, including a policyholder's broker, reinsurer, employer or plan sponsor. These disclosures may be made for the purpose of performing administrative services on our behalf, helping us to administer or review a claim, where we feel it necessary to protect our interests, or as requested by a governmental agency. We will not share any of our customer's health information unless allowed by applicable law and/or the customer has provided us the appropriate authorization.

Parties to Whom We May Disclose Nonpublic Personal Information

We may disclose the information we collect, as described in this privacy policy, to companies that perform services on our behalf in connection with account administration and claims administration. We also may disclose nonpublic personal information to affiliated and nonaffiliated third parties as permitted by law. We will release personally identifiable information in order to cooperate with law enforcement investigations, comply with court orders or subpoenas, protect the legal rights of BCC and our users, or when we believe it is needed for fraud protection and/or credit risk reduction.

  • not use or further disclose Protected Health Information (as that term is defined in HIPAA) other than as permitted by agreement between BCC and any "covered entity" or as required by law;
  • use appropriate safeguards to prevent the use or disclosure of Protected Health Information other than as permitted by agreement between BCC and any "covered entity" or as required by law;
  • mitigate, to the extent practicable, any harmful effect that is known to BCC of a use or disclosure of Protected Health Information in violation of an agreement between BCC and any "covered entity"; and
  • ensure that any agent, including a subcontractor, to whom BCC provides Protected Health Information agrees to the same restrictions and conditions to which BCC is bound.
